## 1. Who we are
Novela Marketing is a trading name of T.G. Visionscale Ltd, a company registered in the Republic of Cyprus under company number HE486061, with its registered office at Aristovoulou 27, Petrou & Pavlou, 3085 Limassol, Cyprus ("Novela", "we", "us", "our").
We are the data controller for personal information collected through offer.novela-marketing.com and in the course of our sales and marketing activity.
You can reach us about anything in this policy at [email protected].
## 2. What this policy covers
This policy explains how we handle personal information about:
- visitors to our website;
- people who submit a form, book a call, or otherwise contact us;
- representatives of our clients and prospective clients.
This policy does not cover patient or enquiry data that we process on behalf of a client practice. Where we operate advertising campaigns, CRM systems, or follow-up messaging for a dental practice, that practice is the controller of that data and we act as a processor on its instructions. Our handling of that data is governed by the data processing agreement between us and that practice, and by that practice's own privacy notice.
## 3. Information we collect
Information you give us
- Name, business name, email address, telephone number, and practice location
- Information about your practice that you share on a call or in correspondence
- The content of emails, messages, and form submissions
- Scheduling information when you book a call through our booking provider
Information we collect automatically
- IP address, approximate location derived from it, browser and device type, operating system
- Pages viewed, time on page, referring URL, and how you arrived at our site
- Cookie and similar identifiers, including advertising identifiers set by third-party platforms
Information from third parties
- Advertising and analytics platforms, where you interact with our ads
- Publicly available business information, where we research a practice before contacting it
Call recordings
Where we record or transcribe a call, we will tell you at the start of the call and ask for your agreement. You can decline and the call will continue unrecorded.
## 4. Why we use your information, and our legal basis
| Purpose | Legal basis (GDPR Article 6) |
|---|---|
| Responding to your enquiry and arranging a call | Performance of a contract, or steps taken at your request before entering one |
| Providing our services to you as a client | Performance of a contract |
| Sending marketing emails and messages about our services | Consent, or legitimate interests in marketing to business contacts |
| Contacting practices that we believe may be a fit for our services | Legitimate interests in business-to-business marketing |
| Measuring and improving our advertising | Consent, for cookies and tracking that require it |
| Website security, fraud prevention, and service reliability | Legitimate interests in protecting our business |
| Meeting legal, tax, and accounting obligations | Legal obligation |
Where we rely on legitimate interests, we have considered whether those interests are overridden by your rights. You can object to that processing at any time using the contact details above.
## 5. Marketing communications
If you give us your details, we may contact you by email, telephone, or text message about our services.
You can opt out at any time by using the unsubscribe link in any email, replying STOP to any text message, or emailing us. We will action opt-outs promptly and keep a suppression record so that we do not contact you again.
We do not sell your personal information, and we do not share it with third parties for their own marketing purposes.
## 6. Who we share information with
We share personal information with service providers who process it on our behalf under contract, including:
- website hosting and CRM providers
- scheduling and calendar providers
- email and messaging providers
- advertising and analytics platforms
- payment processors and accounting providers
- professional advisers, where necessary
We may also disclose information where required by law, to enforce our agreements, or in connection with a sale or reorganisation of our business.
## 7. International transfers
We are established in Cyprus. Some of our providers are located outside the European Economic Area, including in the United States. Where personal information is transferred outside the EEA, we rely on an adequacy decision of the European Commission, or on Standard Contractual Clauses together with any additional safeguards required. You can request details of the safeguards applied by contacting us.
## 8. How long we keep information
- Enquiry and prospect records: up to 24 months from the last meaningful contact, unless you ask us to delete them sooner
- Client records: for the duration of the engagement and 6 years afterwards, to meet accounting and limitation-period requirements
- Marketing suppression records: indefinitely, so that we can honour your opt-out
- Website analytics and advertising data: as set by each platform, typically no more than 26 months
## 9. Security
We use access controls, encryption in transit, and vendor due diligence appropriate to the sensitivity of the information we hold. No system is completely secure, and we cannot guarantee the security of information transmitted to us over the internet.
## 10. Your rights
Depending on where you are located, you may have the right to:
- access the personal information we hold about you;
- correct information that is inaccurate or incomplete;
- delete information, in certain circumstances;
- restrict or object to our processing, including direct marketing;
- receive your information in a portable format;
- withdraw consent where we rely on it, without affecting processing already carried out;
- avoid being subject to a decision based solely on automated processing that produces legal or similarly significant effects. We do not make such decisions.
To exercise any of these, email [email protected]. We will respond within one month, and will tell you if we need longer. We may ask you to verify your identity first.
We will not discriminate against you for exercising your rights.
If you are in the EEA or the UK, you also have the right to complain to a supervisory authority. Our lead authority is the Office of the Commissioner for Personal Data Protection, Cyprus (www.dataprotection.gov.cy).
If you are in California, you have the rights described above under the CCPA as amended by the CPRA, including the right to know what personal information we collect, use, and disclose, and the right to opt out of any sale or sharing of personal information. We do not sell or share personal information as those terms are defined under California law. We do not process sensitive personal information for the purpose of inferring characteristics.
If you are in Canada, you may access and correct your personal information under PIPEDA and may complain to the Office of the Privacy Commissioner of Canada. Where we send you commercial electronic messages, we do so on the basis of express or implied consent as required by CASL, and every message identifies us and provides an unsubscribe mechanism.
## 11. Cookies and tracking
We use cookies and similar technologies that are strictly necessary for the site to function, and, where you consent, cookies for analytics and advertising. This includes tools provided by advertising platforms that help us measure campaign performance and show ads to relevant audiences.
You can manage your preferences through our cookie banner and through your browser settings. Blocking non-essential cookies will not stop you using the site.
Full details of the cookies we set can be seen and changed at any time through the cookie preferences link in the footer of this site.
## 12. Children
Our website and services are directed at businesses and are not intended for anyone under 18. We do not knowingly collect information from children. If you believe a child has provided us with personal information, contact us and we will delete it.
## 13. Changes to this policy
We may update this policy from time to time. The date at the top shows when it was last revised. Where changes are significant, we will take reasonable steps to notify you.
